These Terms of Service (“Terms”) govern your use of the hosting services and website provided by Pine Sentry (“we,” “us,” or “our”) at pinesentry.com. By purchasing a hosting plan or using our services, you agree to be bound by these Terms.

1. Services

Pine Sentry provides managed web hosting services including shared WordPress hosting, cloud servers, domain registration, and related technical services. Service specifications, features, and pricing are as described on our pricing page at the time of purchase.

2. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use.

3. Service Level Agreement (SLA)

Pine Sentry guarantees 99.9% network uptime on a monthly basis, excluding scheduled maintenance windows. Scheduled maintenance will be communicated at least 48 hours in advance when possible. If we fail to meet the 99.9% uptime guarantee in any calendar month, you may request a service credit as follows:

  • 99.0% – 99.9%: 5% credit of monthly fee
  • 95.0% – 99.0%: 15% credit of monthly fee
  • Below 95.0%: 30% credit of monthly fee

Credits must be requested within 30 days of the affected period and apply to future invoices only. Credits do not apply to downtime caused by factors outside our control, including DDoS attacks, DNS issues, or client-side misconfigurations.

4. Acceptable Use

You agree not to use our services to:

  • Host, distribute, or link to malware, viruses, or malicious code
  • Send unsolicited bulk email (spam) or operate open mail relays
  • Host content that infringes on intellectual property rights
  • Engage in illegal activities or host illegal content under United States law
  • Run cryptocurrency mining software or other resource-abusive processes
  • Attempt to gain unauthorized access to other systems or networks
  • Host phishing sites or engage in fraud

We reserve the right to suspend or terminate accounts that violate this policy without prior notice.

5. Payment and Billing

Hosting plans are billed in advance on a monthly or annual basis as selected at checkout. All prices are in US Dollars (USD). Payment is due at the time of purchase and upon each renewal date. We accept major credit cards and other payment methods as displayed at checkout.

Failure to pay may result in service suspension after a 7-day grace period. Suspended accounts will be terminated and data deleted after 30 days of non-payment.

6. Domain Registration

Domain registrations are subject to the terms of the applicable domain registry. Pine Sentry acts as a registrar reseller. Domain fees are non-refundable once the domain has been registered. Auto-renewal is enabled by default and can be managed through your client portal.

7. Data and Backups

While we perform regular automated backups of hosted data, you are ultimately responsible for maintaining your own backups. Pine Sentry is not liable for data loss. We recommend maintaining independent off-site backups of all critical data.

8. Resource Usage

“Unlimited” plans are subject to fair use. Accounts that consume excessive server resources (CPU, RAM, I/O, storage) to the detriment of other users may be asked to optimize their usage or upgrade to a higher-tier plan. We will notify you before taking any action.

9. Account Termination

You may cancel your hosting account at any time through the client portal or by contacting support. Upon cancellation:

  • Services remain active until the end of the current billing period
  • No partial refunds are issued for unused time within the current period
  • Account data will be retained for 30 days after termination, then permanently deleted

We may terminate accounts that violate these Terms, with or without notice depending on the severity of the violation.

10. Limitation of Liability

To the maximum extent permitted by law, Pine Sentry’s total liability for any claim arising from or related to our services shall not exceed the total fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data.

11. Indemnification

You agree to indemnify, defend, and hold harmless Pine Sentry and its affiliates from any claims, damages, or expenses arising from your use of our services or violation of these Terms.

12. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or posted on our website at least 30 days before taking effect. Continued use of our services after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas, United States. Any disputes shall be resolved in the courts located in Dallas County, Texas.
